Minnesota woman loses music downloading appeal

WASHINGTON (AP) — The Supreme Court has turned away an appeal from a Minnesota woman who has been ordered to pay record companies $222,000 for the unauthorized downloading of copyrighted music.

The justices did not comment Monday in letting stand the judgment against Jammie Thomas-Rasset of Brainerd, Minn. She claimed in court papers that the ordered payment was excessive.

The music industry filed thousands of lawsuits against people it accused of downloading music without permission and without paying for it. Almost all the cases settled for $3,500.

Lawyer Kiwi Camara said Thomas-Rasset is one of only two defendants whose case went to trial. The other is former Boston University student Joel Tenenbaum, who also lost and was ordered to pay $675,000.

The case is Thomas-Rasset v. Capitol Records, 12-715.

    JERUSALEM (Reuters) - President Barack Obama is due to make his first official visit to Israel and the Palestinian Territories this week, looking to improve ties after sometimes rocky relations with both sides during his first term in office.

    Obama is not expected to come with any new Palestinian peace initiative and will spend most of his time in Israel, the closest U.S. ally in the Middle East, where he will make a keynote speech to hundreds of students.

    The American president will hold separate talks with both Palestinian President Mahmoud Abbas and Israeli Prime Minister Benjamin Netanyahu, who finally formed a new coalition on Friday after a January election that weakened his grip on government.

    Here are some of the issues that are likely to dominate the March 20-22 visit.

    IRAN AND THE BOMB

    Israel and the United States agree that Iran should never get a nuclear bomb, dismissing Tehran's repeated assertion that its atomic program is peaceful. However, the two allies are at odds over how fast the clock is ticking down on the need for preventative military action should diplomacy fail.

    Netanyahu last year set a "red line" for Iran's nuclear program, saying the Islamic Republic should not be allowed to obtain 240 kg (530 lb) of 20 percent enriched uranium. Israeli officials have warned this tipping point could be reached by the spring or summer of 2013, although experts believe Iran has since slowed its stockpiling of 20 percent fissile uranium to ward off the threat of attack.

    Obama said on March 14 that Iran was still more than a year away from developing a nuclear weapon and repeated his assurance to Israel that military force remained a U.S. option.

    Israeli officials, who see Iran's nuclear advances as an existential threat, make no secret of the fact that they would prefer to see the U.S. military, with its greater firepower, tackle Iran's far-flung atomic installations. Tehran is improving its defenses and Israel worries that sooner rather than later Israeli warplanes will not be able to destroy this infrastructure. This would mean its own military option would be off the table, leaving Israel utterly reliant on Washington.

    The White House believes Israelis have yet to reach a consensus on how to confront Iran, according to a source familiar with the administration's thinking, who added that Obama would stress the need for patience with sanctions and diplomacy. U.S. officials also hope a high-profile recommitment to Israel's security will increase public pressure on Netanyahu to avoid aggravating the situation while negotiations continue.

    NO "GRAND PEACE PLAN"

    Obama is likely to press both the Israelis and Palestinians to return to the negotiating table, but he told American Jewish leaders in private before the trip that he did not intend to deliver a "grand peace plan" during the visit. Participants said the president did not preclude the possibility of launching an initiative in six months or a year.

    The mood was very different at the start of his first term, when Obama said peace between Israelis and Palestinians was a top priority. His 2009 "new beginning" speech in Cairo raised Palestinian hopes of establishing a state in the West Bank, East Jerusalem and Gaza, territories Israel captured in the 1967 Middle East war.

    Obama revived direct peace talks in 2010, but they collapsed soon afterwards when Netanyahu refused to bow to Palestinian demands to extend a partial freeze on settlement building.

    Both the Palestinians and Israelis felt let down by Obama, for very different reasons. The Israelis begrudged the fact that at the start of his first term, he publicly told Israel to halt all Jewish settlement building, saying this put unfair pressure on Netanyahu to make unilateral concessions.

    The Palestinians were furious when Obama then backed away from his demand over settlement construction, saying the peace talks were doomed unless Washington twisted Israel's arm.

    Both sides say that without a serious U.S. engagement, the chances of a deal are close to zero. However, few U.S. analysts expect Obama to expend much political capital on an elusive peace accord that has tied up so many of his predecessors.

    Netanyahu's new government includes former Israeli foreign minister Tzipi Livni, who will take charge of pursuing peace with the Palestinians. But the presence of fiercely pro-settler elements in the coalition, including within the prime minister's own Likud party, suggests a breakthrough is unlikely.

    SETTLEMENT EXPANSION

    Israeli settlement expansion lies at the heart of much of the rancor between Netanyahu and Obama, who has said the United States does not accept the legitimacy of continued settlement.

    Most major powers regard settlements as illegal under international law and an impediment to peace. The Israelis claim historical and biblical ties to the West Bank and East Jerusalem, home to some 500,000 settlers, and dispute their building in these areas is illegal.

    All Israeli leaders since 1967 have backed the settlement movement, but Netanyahu has been especially supportive. Yuval Steinitz, who was replaced as finance minister last Friday, said in November that the government had quietly doubled the portion of the national budget dedicated to West Bank settlements.

    In December and January, Israel announced plans to build more than 11,000 new houses on land Palestinians want for a future state. Pro-settler politicians have landed several top jobs in the new Netanyahu government, including the housing minister, who has pledged to keep on building.

    Many Western diplomats based in Jerusalem privately question whether the so-called two-state solution, of an independent Israel living alongside an independent Palestine, is still viable given the never-ending expansion of settlement blocs.

    Israel's press says Obama has pointedly not invited students from a university in the West Bank settlement of Ariel to attend a speech he is meant to give in Jerusalem this week.

    RELATIONS RESET

    Relations between Obama, 51, and Netanyahu, 63, have been marked by slights, mutual suspicion and outright antipathy.

    Supporters of Netanyahu accuse Obama of trying to browbeat Israel into making concessions to the Palestinians, particularly over the issue of settlements. Obama supporters say Netanyahu interfered in the 2012 presidential election, overtly backing Republican challenger Mitt Romney.

    In one Oval Office meeting in 2011, Netanyahu gave Obama a public lecture on Jewish history. A year later, when the Israeli leader visited the United States, Obama said he was too busy to meet him. They will try to reset their relationship this week.

    Despite the fact that Obama oversaw ever-closer military ties between the two nations, he has never won the affection of ordinary Israelis, who resented the fact that he did not visit their country in his first term, but did go to Egypt and Turkey.

    A poll in the Maariv daily on March 15 said 68 percent of Israelis had an unfavorable or hostile attitude towards Obama, while just 10 percent said they liked him.

    Annual U.S. military aid to Israel is put at $3 billion.

    UPHEAVAL CAUSES FRICTION

    Regional upheaval across the Middle East has proved another source of friction between Israel and the United States over the past two years.

    Israeli officials were especially incensed by what they saw as Washington's approval for the ousting of Egypt's former president, Hosni Mubarak, in February 2011. The late President Anwar Sadat signed the Israeli-Egyptian peace treaty, a pillar of Israel's regional security strategy, in 1979.

    Seen from Netanyahu's office, U.S. policy-making in the region has been naive and failed to anticipate the rise in power of Islamist forces in one Arab nation after another.

    U.S. officials argue that Washington could not have stood in the way of the march of history and believe that dialogue with the new governments that have emerged in the wake of the Arab uprisings is the only way to forge meaningful ties.

    Israel would now like to see the United States play a more active role in supporting non-Islamist rebels battling President Bashar al-Assad in Syria, fearful that growing power vacuums in its northern neighbor will be filled by Jihadist militants.

    Keystone fears resonate along New England pipeline

    SUTTON, Vt. (AP) — The Canadian energy industry insists it has no plans to reverse the flow of a pipeline that carries crude oil from Maine to Montreal, but that has done little to reassure New England towns that oppose the idea and the 18 members of Congress asking for a full environmental review.

    Environmentalists in the U.S. and Canada started raising the alarm about oil they call "tar sands" or "oil sands" being moved through northern New England several months ago.

    "It's a climate-destructive fuel, and Vermont is committed to clean energy," said Jim Murphy, of the National Wildlife Federation. "We don't want to be the pass-through for climate-destructive fuel."

    The Portland Montreal Pipe Line carries foreign crude oil from tankers docked in Portland, Maine, inland to eastern Canada, which imports most of its oil and has refineries there. But as the Canadian energy industry tries to figure out how to profit from new technology allowing them to exploit vast oil reserves in Alberta, it's already looking at ways to ship it east — and, opponents fear, abroad through the Portland conduit.

    Opponents claim moving the Alberta oil through the aging Portland-Montreal pipeline would a threat because it is thicker and more corrosive than the regular crude it now carries, making it more likely to spill and cause an environmental disaster. The oil in question is the same kind that would flow through a controversial extension of the major Keystone pipeline in the central and western U.S.

    "If they find any way at all to get oil sands oil to the eastern Canadian refineries, then I think somebody will argue, 'Let's reverse the Portland-Montreal pipeline because we don't need (that) crude anymore," said David Runnalls, an energy expert with the Centre for International Governance Innovation, a Canadian think tank. "This is all basically just being talked about. How much of this is serious, in the sense that anyone has invested 25 cents in it, is dubious."

    The CEO of the Maine company that owns the pipeline would welcome the opportunity to find new business uses for the 24-inch pipeline, built in the 1950s, which runs through towns in Maine, New Hampshire and Vermont. He has made that pitch in media interviews in the United States and Canada, as well as last month to the Vermont Legislature, but hasn't specifically proposed reversing the flow.

    "We just do not have a project at this time," said CEO Larry Wilson. "We'd consider any number of opportunities, we continue to do so and I want people to comprehend one of the opportunities that we have considered and we'd be happy to consider going forward, is reversal from Montreal into South Portland."

    Raising suspicions of the plans — or lack thereof — is that Calgary-based Enbridge Pipelines Inc. is seeking regulatory working to reverse the flow of another pipeline from Ontario and Montreal, known as Line 9, to carry oil from western Canada to Quebec refineries.

    Still, the company flatly denies having any designs on the Portland-Montreal line.

    "We have no involvement with that company or that line, so it's not really for me to speak on their behalf or to speculate in any way to what their plans are," said Graham White, a spokesman for Enbridge. "The fact that we are reversing Line 9 to the Quebec refineries has no connection whatsoever to the PMPL line or moving any kind of product toward the U.S. coast or Portland."

    The kerfuffle in New England is a less visible component over a larger discussion about how to ship western Canadian crude. The issue is also at play in the proposed Keystone XL pipeline, which would run through several Central and Western states and take the oil to U.S. refineries along the Gulf of Mexico.

    Environmentalists complain the Keystone pipeline and others carrying the same Canadian crude not only are more susceptible to leaks and spills because of the nature of the oil, but also that when burned, the fuel contributes more greenhouse gas emissions than lighter crude.

    The efforts to ship Canadian oil to Eastern refineries and reduce the nation's reliance on imported oil become even sharper if the Keystone plan is rejected by President Barack Obama's administration, Runnalls said.

    There was a brief effort to reverse the Portland-Montreal pipeline in 2008, but it was abandoned during the economic downturn.

    "If you connect the dots, there's huge interest in moving oil out of Alberta, and where is it going to go?" said Sandra Levine, an attorney with the Vermont office of the Conservation Law Foundation, one of the groups fighting the possible reversal of the pipeline.

    The issue has gotten the attention of the members of the U.S. House and Senate, all Democrats save one independent, from as far away as Arizona, who have asked Secretary of State John Kerry to require a comprehensive environmental impact statement should the Portland Pipeline Corp. seek to reverse the flow.

    "The State Department has the responsibility to ensure transnational pipeline projects serve the national interest and prevent projects that will put our communities and the environment at risk of destructive spills," said the Feb. 26 letter to Kerry.

    The talk about tar sands oil galvanized 29 Vermont towns to hold nonbinding votes against reversing the pipeline during town meetings this month. None of the communities that considered the issue voted in favor of the pipeline — but none of the communities that voted host any portion of it.

    In the Vermont town of Burke, just east of a pump station, Carol Krochak, who lives along a brook downstream from the pipeline, read an activist's opinion piece at her town meeting that conveyed the worries of pipeline-reversal opponents.

    "I am not a scientist. I cannot evaluate this," said Krochak, who described herself as "very concerned" and wanted people to know of her fears. "It's critical that people who have that expertise look at it."

    Burke didn't vote against the project, but its planning commission asked the state to examine any reversal proposal through Vermont's land-use planning process, which can take years.

    The votes of concern led the Canadian consulate in Boston to send letters to 23 Vermont towns and to attend meetings in five Maine communities, saying Alberta oil posed no greater threat of a spill or to the environment than traditional crude oil. The letter also stressed officials are unaware of any specific plan to move tar sands oil between Montreal and Portland.

    Runnalls noted, though, that the Canadian oil industry had invested at least $50 billion in Alberta oil.

    "They're ramping up production like mad," he said. "If they can't find more ways to get this out of Alberta, to China or the U.S. or whatever, they're in big trouble."

    NASAの火星探査車「キュリオシティ」、火星の岩に穴をあけるアメリカ航空宇宙局(NASA)は2月7日、火星探査車「マーズ・サイエンス・ラボラトリー(MSL)=キュリオシティ」の振動ドリルを試験するため、火星の岩に穴をあけたと発表した。

     発表によると、この試験は「ミニドリル試験」と呼ばれ、火星の岩「ジョン・クライン」に対し、「キュリオシティ」の振動ドリルによる掘削作業が2月6日に行われ、その結果、幅約1.6cm、深さ約2cmの穴をあけたという。

     チームは今回の試験結果について評価し、もし問題がなければ、数日以内にも本格的な掘削作業を開始する予定だ。

     掘削対象に選ばれたのは「ジョン・クライン」は平坦な岩石で、浅い盆地「イエローナイフ湾」の内部に存在している,最後まで集中して走ってくれたら」と変わり身を期待していた。これまでの分析によれば、この岩石には様々な粒子が存在し、水の存在を示す証拠があるかもしれない。

    男女の脳はつくりが違うとは聞いたことがあったけれど、これほどまでに違うものだとは思わなかった。そもそも男女では見えている景色が違うらしい。女性には見えて、男性には見えない色というものが存在するそうだ。そんなことは考えてみたこともなかった。とすると異性というのは、似て非なる生き物である。多くの大人たちはそのことを理解せず、異性の脳を自分の脳と同じものとして扱おうとするから、ストレスを感じてしまう。著者いわくそれは

    ように見えるそうだ。その性能の違いから男女のすれ違いはよく起こる。オーブントースターにはオーブントースターの使い方があるように、男性脳には男性脳の、女性脳には女性脳の使い方がある。その違いを理解することで、異性とのコミュニケーションがより円滑になり、お互いにハッピーになれるのではないだろうか。思ってもみなかったことが異性にとっては地雷だったりする。その地雷を避けるためにもこの本はとても有効である。

    女性が料理を準備していて、その間ずっとテレビを見ている男性。そろそろ出来上がりそうだという頃合いになっても、男性はまだテレビを見ている。そして女性から「どうしてそうなの?」と怒られる。こういった風景は容易に想像がつく。私にも身に覚えがある。出来上がりそうだと思って、テーブルを片づけて、取り皿を用意する。そういったことが男性にはできない。なぜなら察して先んじてフォローをする。そういった性能が男性脳には搭載されてないからだ。女性にはまずそのことを理解してもらいたい。決して思いやりがないから、動いていないのではない。脳にその機能がないので、言われないと思い至らないだけである。

    こう言われても、できる男もいるでしょ?そんなのは言い訳にしかすぎない。という女性がいるだろう。しかし、これらの能力は後天的に身につけたもので、一般の男性には搭載されてないのが現実だ。いうなればオプションみたいなものなのだ。ではどうしたらいいか?女性から「○○は、あなたにお願いするわね。よろしくね。」といえば、男性がやってくれるようになるかもしれない。男というのは計画的に任務を遂行する能力には優れているから、それが自分の任務となれば確実にやってくれるはずだ。

    上記のシチュエーションで、「言ってくれればやったのに」という言葉を、彼女や妻に発したことのある男性はいないだろうか?もし言ったことがあるのならば、この本を読んで悔い改めたほうがいいだろう。そして二度とこの言葉は使わないことをオススメする。この言葉は「夫のムカつく一言」というアンケートで堂々の2位にランキングされている。男にとってはフォローのつもりで言っているのだけど、女性からすると「察することを放棄することば」に聞こえ、言われると想像以上に傷つくそうだ。

    女性にとってはこれから起こるべきことを察し、先んじてフォローしてくれるということが、自分をいつも大切に思ってくれているという証になるのだ。だからレディーファーストの精神は理にかなっているし、女性から喜ばれる。モテる男はこういったことをさり気なくやるんだよね。一般の男性にはこの資質は備わってないので、こういうときは「言ってくれればやったのに」ではなく、「気がつかなくてごめん」というべきである。これだけで家庭円満になるかもしれない。

    このように、男女の脳の性差とその対処法がこの本には載っている。女性はなぜ突然キレるのかとか、女性に過去の浮気を告白してはいけないだとか、男女間の地雷の回避方法がわかり、個人的にも多いに参考になった。(いままでいかに地雷をどっかんどっかん踏んできたかを大いに気づかされた)

    Gov. wants to toss NCAA sanctions against PSU

    STATE COLLEGE, Pa. (AP) — Pennsylvania's governor says he intends to file a federal antitrust lawsuit against the NCAA in an effort to overturn what he said were "harsh penalties" against Penn State because of the Jerry Sandusky child sex abuse scandal.

    Gov. Tom Corbett, flanked by members of his staff and current and former students and athletes from the school, says the NCAA punished students, the community and businesses around the university, not the former assistant football coach who molested children.

    The sanctions imposed in July included a $60 million fine for child abuse prevention grants, a four-year bowl game ban for the university's marquee football program and the forfeiture of 112 wins.

    Corbett says the lawsuit to be filed later Wednesday would show the NCAA actions were overreaching and unlawful.

    Israeli West Bank raid sparks clashes with Palestinians

    JERUSALEM (Reuters) - Israeli forces raided the West Bank city of Jenin in search of a suspected Palestinian militant on Thursday, setting off clashes with residents who threw rocks and petrol bombs at them, an Israeli security source said.

    It was the second time this week that Israeli forces had entered the Jenin area to detain suspects.

    On Tuesday, Israeli soldiers disguised as Palestinians raided the village of Tamoun, arresting a member of the Islamic Jihad group. Several dozen Palestinians were injured in ensuing clashes, medical officials said.

    In Thursday's incident, the soldiers clashed with some 500 Palestinians, forcing them out of Jenin, the security source said. An elderly Palestinian woman was slightly injured by a dog used by Israeli forces during the operation.

    A military source said a Palestinian was arrested in Thursday's raid - though not the suspect in whose pursuit Israel had launched the operation. The source did not give further details on the detainee.

    Jenin is under the control of the Palestinian Authority, which exercises limited self-rule in the West Bank under interim peace accords with Israel.

    Israel has reserved the right to carry out its own operations against militants in the West Bank.

    Subaru recalls vehicles for lighting issue

    (Reuters) - Subaru is recalling as many as 634,000 vehicles in the United States for potential lighting problems that could lead to smoke or fire, according to U.S. safety regulators.

    The recall by Subaru, owned by Fuji Heavy Industries Ltd, potentially affects some Forester vehicles from model years 2009 through 2012, all Legacy and Outback vehicles from model years 2010 through 2012, and some Tribeca vehicles from model years 2006 through 2012, according to documents filed with the U.S. National Highway Traffic Safety Administration.

    The 633,842 vehicles potentially affected by the recall may be equipped with accessory puddle lights that when lit brighten the areas under the doors, according to NHTSA documents.

    A Subaru spokesman said the recall involves only 53,999 cars equipped with the lights, but the wider number of owners must be alerted because the company does not know which cars have them.

    There have been no reports of accidents or injuries related to the issue, but there was one report of smoke, the spokesman said.

    A short circuit can develop when the light or connector are exposed to an electrolytic moisture source such as road spray that has road salt in it, the NHTSA said. That can cause heat that could melt the plastic, resulting in smoke or fire.

    Subaru will notify owners, and dealers will install an additional harness, the NHTSA said. The recall is expected to begin next month.

    Science in Ice: Lab Operates Inside a Glacier

    Nearly 700 feet (more than 200 meters) under the Svartisen glacier in northern Norway, researchers are huddled together underground. In the world's only lab located inside one of these giant hunks of ice, they are carrying out some of the best experiments on the movement and composition of glaciers ever done.

    The lab, operated by the Norwegian Water Resources and Energy Directorate, is located above the Arctic Circle. It started out as a tunnel for hydropower, but then researchers persuaded the hydropower company to dig out one small extra tunnel just for them and created a valuable in-site lab.

    Normally to get access to the base of a glacier, it is necessary to drill a borehole through the ice. Doing so involves a huge logistics operation and also means that researchers can work only where the surface ice isn't too badly cracked. Using the new lab, researchers can visit exactly the same location at the glacier bed each time — and it's much easier for them to get access to the base.

    But the in-site lab comes with its own set of challenges.

    Icy challenges

    To access the remote workspace, researchers have to fly to a small northern Norwegian town, then drive for hours, take a ferry, walk along a dirt road and up a mountain. From the entrance to the tunnel, it's another mile-plus trek up a set of stairs to the lab. It's a one-hour walkin total when conditions are good, but when there is fresh snow to trudge through on the way to the entrance, the slog can take four to five hours.     To get to different parts of the glacier bed to study how the ice slides over the rock beneath, the researchers melt additional 30- to 40-foot-long (9 to 12 m) tunnels using hot water. "The water is heated up in a large hot-water heater that is in the main tunnel. The hot water is then pumped up the ice tunnel," said Miriam Jackson, a senior research scientist and glaciologist with the directorate. Melting a glacier from the inside out is a slow process — creating one ice tunnel takes around 24 to 48 hours.

    Working under the glacier instead of the cold surface protects the researchers from some challenges, but it's still a tough environment.

    "Some people find the stress of being in the tunnel system a challenge, and although this is unusual, tempers can occasionally fray, especially for groups that have limited experience of glaciological fieldwork," Jackson said.

    Seismic signals and sliding

    Once in the lab, the scientists continue their work in trying to get a read on how glaciers move and how they drain throughout the year, as well as how glaciers impact sea level rise by contributing melt water to the oceans. The laboratory is also being used to test and develop theories about the seismic signals — similar to those measured from earthquakes — that moving glaciers send.

    "We can put the seismic instruments in the tunnel system, they are a lot nearer to the base of the ice, whereas normally scientists must put the instruments on the surface, even when they are studying what is happening at the base," Jackson told OurAmazingPlanet.

    The team only does research in the wintertime to avoid meltwater, and the research area has room for up to six people sharing four bedrooms, a kitchen, bathroom and a shower in addition to three laboratories, a walk-in freezer, a workshop and a water heater. Most of the time there are only three to four people in the labfor a period of six to seven days between November and April.

    Recent experiments measured the resistance to sliding at the base of the glacier and found that most of the resistance is due to the friction between the debris-rich ice and the bedrock — a finding that was a surprise. Previously researchers thought that ice flow past particular obstacles in the bedrock provided most of the resistance to friction of the glacier.

    The ice tunnel labs provide the researchers with more than just a research site, though.

    "One of the most surprising things is the beauty," Jackson said. "Each time we melt out an ice tunnel it is equally entrancing."

    ANCHORAGE, Alaska (AP) — High seas and strong winds prevented crews from boarding an oil drilling ship to check for any damage after the large vessel went aground off an uninhabited island in the Gulf of Alaska.

    A Coast Guard plane and a helicopter flew over the Kulluk on Tuesday, but severe weather didn't permit putting marine experts on board the drilling rig, which had grounded on a sand and gravel beach in stormy seas.

    Federal on-scene response coordinator Capt. Paul Mehler said the Royal Dutch Shell drilling rig is carrying about 143,000 gallons of diesel and about 12,000 gallons of lube oil and hydraulic fluid, and appeared stable.

    "There is no sign of a release of any product," Mehler said during a news conference.

    A team of company, Coast Guard and local officials said they were mobilizing spill response equipment and preparing a plan in the event of a spill in the Partition Cove and Ocean Bay areas of the island. The area is home to at least two endangered species, as well as harbor seals, salmon, and sea lions.

    The storm eased Tuesday, with gusts up to 35 mph and waves up to 30 feet high, and similar conditions were expected Wednesday. Officials were hoping to get marine experts onboard to take photos and videos, and then come up with a more complete salvage plan once weather permits.

    The goal was to get salvagers aboard the Kulluk and the ship refloated, Mehler said.

    Mehler said a team of about 500 people was working on a plan, "with many more coming."

    A Shell official said the drilling rig was built with a double-sided hull of reinforced steel that is 3 inches thick. It recently had undergone $292 million in improvements before being put into service for a short time this summer in the Beaufort Sea off Alaska's north coast.

    It was being towed to Seattle for maintenance last week when it separated from a towing vessel south of Kodiak Island. Repeated attempts to maintain towing lines were unsuccessful as a severe storm passed through the area. By Monday night, tow boats guided the rig to a place where it would cause the least environmental damage and cut it loose. It grounded off the southeast side of uninhabited Sitkalidak Island, which is near the larger Kodiak Island in the gulf.

    U.S. Rep. Ed Markey, D-Mass., the top Democrat on the Natural Resources Committee, expressed his concerns in a statement Tuesday.

    "Oil companies keep saying they can conquer the Arctic, but the Arctic keeps disagreeing with the oil companies," Markey said. "Drilling expansion could prove disastrous for this sensitive environment."

    Sean Churchfield, operations manager for Shell Alaska, said once the situation is under control, an investigation will be conducted into the cause. He did not know whether the findings would be made public.

    The Coast Guard said it would be investigating and would make its findings public.

    Doctor urges limited use of Boston Scientific's new device

    CHICAGO (Reuters) - Boston Scientific Corp's new leadless implantable heart defibrillator, hailed by some as a breakthrough, should be used on a limited basis until more data are collected, a prominent cardiologist wrote in an editorial of a top medical journal.

    Leads, or wires that carry electrical pulses from the defibrillator - which is implanted in the chest - to the heart have always been the weak link in these systems, used to treat irregular heart beats. All of the device makers have had problems at one time or another with leads.

    Boston Scientific bought the leadless technology, known as a subcutaneous implantable cardioverter-defibrillator, or S-ICD, when it acquired Cameron Health last year. The Cameron device was approved by the U.S. Food and Drug Administration in the fourth quarter.

    "The S-ICD has not yet been shown to be safe and effective in a diverse patient population," Robert Hauser wrote in the January issue of the Journal of the American College of Cardiology.

    Hauser, of the Minneapolis Heart Institute, who has been a vocal critic of medical device companies, also noted that the leadless ICD has not even been shown to be as good as the traditional ICDs that use leads.

    He said the technology is a promising one that could fill important gaps, especially by bringing it to countries where facilities to implant traditional devices is not available, but more data are needed first.

    "Unless critical questions with regard to safety and efficacy in primary and secondary prevention are addressed, the S-ICD should be confined to certain subgroups," he said.

    Dr. Ken Stein, Boston Scientific's Chief Medical Officer for Cardiac Rhythm Management, said there was more in Hauser's editorial that he agreed with than disagreed with.

    "But it was approved by the FDA as being safe and effective," he noted in a telephone interview. "It's an alternative for physicians to consider. We agree there are absolutely some patient populations that shouldn't get it," he said.

    For example, patients who have a slow heartbeat or uncoordinated pumping function should not get it because the S-ICD cannot pace a slow heart beat or resynchronize contractions of the heart's ventricles. On the other hand, the S-ICD may be a better choice for patients who are at risk for sepsis, a severe blood infection.

    "For some patient populations, this is the best option," Stein said. "Somewhere in that middle ground is where the line should be drawn."

    Stein said the company is currently running clinical trials and registers that will render more data, some of which will be presented in the spring at the Heart Rhythm Society meeting.

    Wells Fargo analyst Larry Biegelsen called the S-ICD technology "transformational" but said this first generation device is likely to be a niche product.

    "We estimate the eligible S-ICD opportunity is currently about 14 percent of the total worldwide ICD market, but estimate penetration will be low due to limitations of the first generation device," he wrote in a research note.

    Biegelsen estimated worldwide sales of the S-ICD device to be $46 million in 2013. Boston Scientific had sales of $5.4 billion in the first nine months of 2012.

    Biden and McConnell may have saved the day with their long working relationship.

    ‘Fiscal cliff’ deal leaves everyone bruised, but some more so than others

    The bill to avoid the "fiscal cliff" is finally passed and signed by President Barack Obama, and the culmination of intense negotiations between Republicans and Democrats seems to have left nearly everyone unhappy—or, at most, begrudgingly grateful that some kind of deal was reached.

    Unlike elections, the legislative process doesn't always offer a clear winner and loser, and the battle over how to avoid nearly $600 billion in painful spending cuts and tax increases was no exception. But some escaped with fewer cuts and bruises than others. Here are the "winners" and "losers"—terms we use loosely.

    'Winners'

    President Barack Obama: The president took a beating from his own party two years ago when he cut a deal with Republicans that temporarily extended income tax rates for all income earners set by former President George W. Bush. This time, Obama refused to budge on one of his main campaign promises to increase taxes on wealthy taxpayers. As part of this deal, the income tax rate for individual earners above $400,000 and families earning above $450,000 will increase.

    The president, however, failed to hold together a "grand bargain" with Republicans in what could have been a major opportunity to address ballooning entitlement spending and tax reform. But in the grand scheme of things, Democrats seemed to have come out on top.

    Former President George W. Bush: The final language of the bill left many of Bush's tax rates in place. The passage suggests that there is bipartisan agreement that income tax rates on the middle-income earners should not increase. Also, taxes on capital gains and dividends will remain at 15 percent for income earners below the $400,000 threshold.

    While the bill that Bush championed during his presidency had an expiration date, the tax rates set under the fiscal cliff deal are permanent.

    Senate Minority Leader Mitch McConnell and Vice President Joe Biden: While Obama, House Speaker John Boehner and Senate Majority Leader Harry Reid found it difficult to play nice during the negotiations, Biden and McConnell may have saved the day with their long working relationship. (Before joining the Obama administration, Biden served with McConnell in the upper chamber from 1985-2009.) Known as "the McConnell whisperer" because of his ability to work with the minority leader, Biden was able to communicate the president's message in a way Obama could not.

    Indeed, it was not until Biden stepped in during the final days of negotiations that it looked as though an agreement would be reached.

    Unemployed Americans reliant on federal programs: Federal benefits for Americans who have been without work for more than 26 weeks will be extended for one year, although the provision is not offset by spending decreases elsewhere.

    Hollywood: The bill extended a tax break to the film and television entertainment industry for one more year. The tax incentive is meant to encourage production companies to film in the U.S. The provision costs federal coffers $430 million in potential revenue—which is something to remember when you spend $15 on a movie ticket.

    'Losers'

    House Speaker John Boehner: Although Boehner's efforts helped avoid the potential disaster of going over the fiscal cliff, much was conceded. Obama was able to increase federal spending and raise taxes, outcomes that many Republicans worked tirelessly to avoid. The process showed that Boehner still lacks control over his caucus, which largely rejected his own proposal. This includes his own deputies, House Majority Leader Eric Cantor of Virginia and House Whip Kevin McCarthy of California, who voted against the final deal that Boehner helped negotiate.

    The federal deficit: Compared with what would have happened had the federal government gone completely over the fiscal cliff—including the millions in tax increases and spending cuts that would have reduced the deficit but possibly plunged the nation into another recession—the new deal increases the deficit about $4.6 trillion over 10 years. "Washington missed this magic moment to do something big to reduce the deficit, reform our tax code and fix our entitlement programs," said Campaign to Fix the Debt co-founders Erskine Bowles and Alan Simpson in a joint statement.

    Grover Norquist: The founder and president of Americans for Tax Reform says the fiscal cliff deal is not a violation of his group's anti-tax pledge. (Almost every Republican member of Congress signed a pledge never to raise tax rates.) But compared with tax rates in 2012, the final deal increases federal revenue by about $600 billion over 10 years and most Americans will receive less take-home pay in the new year.

    While Norquist isn't technically calling the vote for the deal a vote for a tax increase, it is the first time since the George H.W. Bush administration that so many Republicans have approved such a broad tax hike.

    Workers who will pay more into the payroll tax: The deal does not extend the payroll tax holiday, which means the federal government will take 6.2 percent from paychecks, as opposed to the  4.2 percent rate in 2012.
